1. About this service

Mercosur TradeFlow (“we”, “our”, “us”) operates the tariff savings calculator at eu-mercosur-trade.com (the “Service”). The Service provides indicative estimates of tariff savings arising from the EU–Mercosur Association Agreement. By using the Service you agree to these Terms.

2. No warranty on tariff data

All tariff rates, HS code classifications, and savings estimates are provided for informational purposes only. We make reasonable efforts to keep the data accurate, but we do not guarantee that it is current, complete, or error-free.

Tariff schedules are subject to change by governments and international bodies. You should verify any figures with a qualified customs broker, trade lawyer, or the official publications of the relevant customs authorities before making business decisions.

The Service is provided “as is” without warranty of any kind, express or implied. We disclaim all implied warranties, including merchantability and fitness for a particular purpose.

3. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed €100 (one hundred euros).

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, scrape, or extract the underlying tariff database in bulk by automated means.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Circumvent any access controls or rate limits implemented to protect the Service.
• Resell, sublicense, or commercially redistribute the tariff data without our prior written consent.

5. Accounts

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Intellectual property

The Service, including its design, software, and original content, is owned by Mercosur TradeFlow and protected by applicable intellectual property laws. The underlying tariff schedule data is derived from public EU and Mercosur government sources and is not claimed as our proprietary information, but our selection, arrangement, and presentation of that data is protected.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the GDPR.

8. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

9. Governing law

These Terms are governed by and construed in accordance with the laws of the European Union and, to the extent not inconsistent with EU law, the laws of the jurisdiction in which we are established. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
